1. General provisions

1.1.

These terms and conditions of sale (hereinafter "Terms and Conditions") apply to all sales of Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini products (hereinafter "Products" or "Product") concluded remotely through the website https://rebornshoes.com (hereinafter the "Website").

The use of the remote sales service described in these Terms and Conditions is reserved exclusively for consumers (hereinafter "Customers" or "Customer"), understood as natural persons acting for purposes outside of their commercial, craft, business or professional activities, over the age of 18 (or if minors, with the authorisation of their legal guardians).

The Customer is called on to carefully read the Terms and Conditions that have been made available on the Website, in order to enable the Customer's knowledge, conservation and reproduction thereof pursuant to Article 12, paragraph 3, of Legislative Decree no. 70 of 9 April 2003, ("Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, in particular, electronic commerce" - hereinafter "Ecommerce Decree"). The Customer, on completion of the purchase, expressly accepts all conditions included in this contract.

1.5.

Contracts concluded with Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini (as defined below) through the Website are governed by Italian law and in particular by Legislative Decree no. 206 of 6 September 2005, (hereinafter the "Consumer Code"), the Ecommerce Decree, European industry regulations and relevant international treaties, to which Italy is party.

5. Purchase methods

5.1.

7. Conclusion of the contract

7.1.

8. Invalidity of the purchase order

8.1.

As an exception to the provisions of paragraph 7 above, no purchase order must be considered accepted by Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini and no contract between Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini and the Customer must be considered concluded if Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini has reasonable grounds to believe that the Customer:

(i) intends to purchase the Products for purposes related to their own or other people's business or professional activities, in accordance with the provisions of paragraph 1.2 of these Terms and Conditions; or

(ii) does not operate on the basis of a real and genuine interest in the purchase of the Products ordered, or

(iii) improperly exercises the right of withdrawal acknowledged in paragraph 11 below.

8.2.

In such cases, the purchase order submitted by the Customer shall be without any force and effect whatsoever. Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini will send to the Customer, via e-mail, a notice stating the non-acceptance of the purchase order by the Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini and the non-conclusion of contract, and will undertake also to cancel all charges and/or expenses borne by the Customer.

9. Shipping and delivery

9.1.

For security reasons the Products purchased on the Website will be sent to the address to which the credit card is registered, unless specified otherwise by the Customer, and the signature of the customer or an authorised adult older than 18 will be required at the time of delivery. Deliveries will not be made to PO boxes.

9.2.

For each order completed on the Website, Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini shall issue an invoice for the Products shipped, to be sent via e-mail to the Customer pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. 9.3.

Delivery costs are borne by the Customer and are clearly indicated on the order form.

9.4.

All purchases will be shipped via DHL courier (hereinafter the "Courier") from Monday to Friday and excluding Saturdays, holidays and local or national holidays, and in any case within 20 working days after the confirmation date of execution of the purchase order. Courier delivery times may be up to a maximum of 5 further working days. In case of costum products an extra week will be added to execute the order.

9.5.

In any case, except in cases of force majeure or unforeseeable circumstances, pursuant to Article 54 of the Consumer Code, Products will be delivered within a maximum period of thirty (30) days from the day following the conclusion of the contract in accordance with paragraph 7.1 above, provided that Calzaturificio Eredi Masolini Raimondo Snc di Daniela, Bruno e Sergio Masolini does not give notification - within the same period or by the last date agreed for delivery, including by e-mail - of inability to deliver the Products ordered due to sudden and temporary unavailability of the Products. 9.6.

Delivery of the Products requires the presence of the customer or his/her appointed representative at the address indicated in the order. At the time of delivery of the Products by the Courier, the Customer shall check:

(i) that the number of parcels is same as that reported in the delivery note (DDT);

(ii) that the packaging is intact and not damaged, wet or otherwise altered, including the sealing materials. Any damage to the packaging and/or the Product or an incongruent number of parcels or wrong information must be immediately notified in writing on the Courier's proof of delivery. Once the Customer has signed the Courier's delivery note without objection, the Customer may not thereafter file any claims regarding the external condition of the delivered package.

10. Confirmation shipping and delivery

10.1.

11. Right of whithdrawal

11.1.

Only if the Customer accepting the contract is a Consumer (meaning by this definition any person who is on the Website for purposes unrelated to business or professional activity), will they have the right to withdraw from the contract with the Seller, without penalty and without giving any reason, within fourteen (14) working days from the day the goods purchased on the Website are received.

11.2.

11.3.

After receiving the email previously mentioned, the Customer will receive all the instructions for returning the Product (s).

11.4.

The right of withdrawal is subject to the following conditions:

- The returned Products must be returned in their entirety and not only parts or components of them even in the case of kits;

- The returned Products must not have been used, worn, washed or damaged;

- The returned Products must be returned in their original packaging without damaged;

- Products must be returned to the Seller in a single shipment. The Seller reserves the right not to accept Products of the same order returned and delivered at different times;

- Products must be delivered to the Courier within fourteen (14) working days from the date they were received;

- If the Seller allows the Customer to return Products which were bought at a lower price thanks to a package deal (e.g. 5X4, 3x2, etc.),  it will be possible to return single items from the package. In this case, the price will be recalculated by referring to the normal whole price of the single item. In all other cases (e.g. bundling options, prizes etc.), the right of withdrawal may be exercised only with the return of all the Products purchased, thus ruling out any partial exclusion.

11.5.

If the withdrawal right is exercised by the Customer in accordance with the above conditions (section 11.4), the Seller shall refund the amount paid by the Customer no later than 30 days after the Seller has received the returned Products. Normally the charge back of the amount by the Seller happens very quickly, but the timing in which the crediting will actually be visible to the Customer will depend on their bank, credit card company or PayPal.

11.6.

When returning, the shipping costs charged to the customer.

11.7.

The Seller accepts to pay for the costs of the initial shipment of Products only in case of damage to the same due to transport or incorrect shipment by the Seller. Only in such cases, the Seller will have to reimburse the amount the Customer has paid for shipping. The Seller will post a Courier to pick up the Product at the address indicated by the Customer.

11.8.

To make a return, the Customer will have to only use the Courier indicated by the Seller in the return instructions: in this way the Customer will not have to personally pay to return the Products purchased because the Seller will pay directly. Subsequently the Seller, unless as stated in paragraph 8.7 and for returns due to Product defect, will withhold an amount equivalent to the shipping cost and home delivery (differs according to Country) when reimbursing the Customer.  This way, once the Products are given to the shipping agent specified in the Online Return Form, the Seller releases the Customer from any liability in case of loss or damage to the Products during transport.

11.9.

In the case of exercising the right of withdrawal without complying with the procedures described above (e.g. taking more than the 14 days agreed to by law, or not following the return instructions), the Seller will post the purchased Products to the Customer charging them the additional shipping charges.

11.10.

The right of withdrawal can not be applied to Products which have been customized on the Customer's request at the time of order.

12. Non-conformities

12.1.

15. Applicable law and competent court

These Terms and Conditions are governed by Italian law and shall be interpreted in accordance with Italian, Community and international laws.
